During child labor or delivery, when an infant can’t get enough oxygen, or receives a head or spine injury, organ and tissue damage usually follows.

  • Children who undergo birth trauma can develop a host of brain injuries, including Cerebral Palsy and Erb’s Palsy. These conditions range from mild to severe, depending on the degree of brain or nerve damage.

  • Most birth trauma is considered to be of an obstetric nature – that is, “spontaneous,” and out of the doctors’ hands. However, the most severe and lasting birth injuries often result from a number of medical errors. Too much pressure exerted on a baby’s face with forceps, for example, can lead to facial paralysis.

  • Erb’s Palsy is predominantly caused by “shoulder dystocia” – a complication in which the baby’s shoulders impair his or her passage through the birth canal. When doctors fail to anticipate these sorts of complications, or fail to respond to fetal distress, the infant can end up with permanent nerve or brain damage.

The legal team at Phillips & Paolicelli, LLP has the resources and expertise to determine whether this damage was brought on by medical malpractice.  Our lawyers assist parents faced with birth trauma by evaluating their specific case, and reviewing the injured child’s medical records in order to develop a malpractice claim.
